Intempt Technologies LLC (“Intempt,” “we,” “us”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and otherwise process Personal Data when you visit our websites (including www.intempt.com), use our applications (including any dashboards, APIs, SDKs, and tracking technologies), and interact with us (collectively, the “Services”).
Personal Data means information that relates to an identified or identifiable individual.
How Intempt Processes Data (Controller vs. Processor)
Intempt may act in different roles depending on the context:
- Intempt as a Controller (our website + business operations).
We act as a controller of Personal Data when you visit our websites, request a demo, sign up for an account, communicate with us, attend events, or otherwise interact with Intempt directly. - Intempt as a Processor (Customer Data in the platform).
Intempt is a processor when our customers use Intempt’s customer data platform and related features (such as tracking, identity resolution, segmentation, journeys/automation, messaging, experimentation, personalization, analytics, session replay/heatmaps/keystroke capture, and AI features) to collect and process data about their end users or contacts (“Customer Data”). In this role, our customers are responsible for determining the purposes and means of processing and for providing required notices and obtaining required consents. - Intempt as a Controller for limited platform data.
We may act as a controller for certain platform-level data we process for our own purposes, such as platform security, fraud/abuse prevention, product analytics, and compliance.
If you are an end user interacting with an Intempt customer, and you want to exercise rights relating to Customer Data, you should contact that customer. We also provide in-product tools to help our customers fulfill requests.
1. What Information We Collect and Process
1.1 Information You Provide to Intempt
We collect Personal Data you provide directly, such as:
- Contact and professional info: name, email address, phone number, company, job title.
- Account info: username, authentication details, and settings/preferences.
- Support and communications: messages, support tickets, and related information you share with us.
- Billing/admin info: billing contact details and subscription administration details.
- Event and marketing info: webinar/event registrations and responses to surveys or forms.
1.2 Customer Data We Process on Behalf of Customers
Customers may upload, send, or collect Customer Data using Intempt, including via:
- Web tracking pixel and mobile SDKs (iOS/Android) that collect events and identifiers (depending on customer configuration).
- Identity resolution using deterministic identifiers (e.g., email, user IDs, device/app identifiers).
- Messaging orchestration (email/SMS/WhatsApp/push) and capture of deliveries, opens, clicks, replies, and unsubscribe events.
- Session replay, heatmaps, and keystroke capture, including data from customer websites or apps where enabled in the product.
Session replay/keystroke capture defaults. Session replay and keystroke capture capabilities are enabled by default in the Services. Customers are responsible for configuring their implementation (including any masking, exclusions, or consent gating they require) and for providing required notice and obtaining required consents under applicable laws.
Customer Data may include identifiers (email/phone/cookie IDs/device IDs), event/behavioral data, profile attributes, preferences, and communications content. We process Customer Data under customer instructions and applicable agreements.
1.3 Information We Collect Automatically (Websites and Services)
We may automatically collect:
- Device and log data: IP address, browser type, device type, OS, timestamps, language, referring URLs, and similar technical data.
- Usage data: actions within the Services (e.g., feature usage, configuration changes, API activity), used for operations, support, security, and product improvement.
- Cookies and similar technologies: described in Section 6.
1.4 Information We Collect From Other Sources (Including Enrichment)
We may receive Personal Data from third parties, including:
- Service providers supporting operations (hosting, support tooling, analytics, billing, etc.).
- Partners and co-marketing/referral relationships (where applicable).
- Enrichment partners: Intempt offers enrichment capabilities where professional/business contact data may be sourced from partners and made available to customers as part of enrichment features. Where an enrichment partner supports deletion/opt-out, individuals may request removal through the partner process (and we will facilitate routing where applicable).
2. How We Use Personal Data
2.1 Provide the Services
Including: account creation, authentication, delivering platform features, troubleshooting, personalization of the product experience, and providing customer support.
2.2 Communicate with You
Including: responding to inquiries, providing service notices, billing/administrative communications, and customer support.
2.3 Improve and Develop the Services
Including: understanding feature usage, improving performance and reliability, and developing new features.
2.4 Security, Abuse Prevention, and Compliance
Including: detecting and preventing fraud, spam, phishing, unauthorized access, and enforcing our acceptable use and platform protections.
2.5 Marketing and Advertising (Where Permitted)
We may use Personal Data to market and promote Intempt, including:
- Email marketing where permitted by law (you can opt out as described below).
- Retargeting and advertising via third-party platforms (e.g., Google/Meta/LinkedIn), including measurement and attribution.
- Enhanced conversions (including hashed identifiers) to measure advertising performance where enabled.
2.6 Call Recording / Transcription (Where Enabled)
We may support recording and/or transcription of calls, including recordings initiated through Google Meet recording features and recordings through telephony providers such as Twilio, where enabled. Recordings and transcripts may contain Personal Data, and customers are responsible for obtaining any required notices and consents when recording calls with end users.
2.7 AI Features
Intempt provides AI and agent features that may process Customer Data or other Personal Data to generate outputs for customers (e.g., assistance with marketing workflows, segmentation, insights, or content generation). We do not use Customer Data to train our own models.
Where enabled, Intempt may send prompts and relevant content to third-party AI providers (including OpenAI and Anthropic) to provide AI functionality. Those providers process data under contractual restrictions to provide the service and help maintain security and integrity.
2.8 Legal Bases (EEA/UK/Switzerland)
Where EU/UK/Swiss law applies, our legal bases may include performance of a contract, legitimate interests (e.g., security and product improvement), consent (e.g., certain cookies/marketing), and legal obligations.
3. How We Share Personal Data
We share Personal Data only as described below:
3.1 Service Providers
We use vendors to operate our Services. Core examples include:
- AWS (hosting and infrastructure)
- Intercom (customer support and communications tooling)
- Stripe (billing and payment processing)
We may also use additional vendors for analytics, security, deliverability, messaging, session replay tooling, and AI features. Service providers are authorized to process Personal Data only as necessary to provide services to us and must protect it.
We maintain a separate Data Processing Agreement (DPA) and a separate subprocessor list for customers.
3.2 Messaging and Communications Providers (Customer-Configured)
Where customers use messaging features, delivery may be provided via third parties, including:
- Email delivery via SendGrid
- SMS/voice via Twilio
- WhatsApp via WhatsApp Business API (through applicable providers)
- Push via FCM/APNs
3.3 Legal, Safety, and Rights
We may disclose Personal Data to comply with law or lawful requests, protect rights and safety, prevent fraud and abuse, and enforce agreements.
3.4 Business Transfers
If we are involved in a merger, acquisition, financing, bankruptcy, dissolution, or sale of assets, Personal Data may be transferred as part of that transaction, subject to appropriate protections.
4. International Data Transfers
Intempt is based in the United States, and we primarily process and store Personal Data in the United States.
Where required for cross-border transfers (including from the EEA/UK/Switzerland), we rely on appropriate safeguards such as Standard Contractual Clauses and other lawful transfer mechanisms.
Data residency: We currently support US data residency. We do not currently offer EU data residency.
5. How We Store and Secure Personal Data
We maintain administrative, technical, and organizational measures designed to protect Personal Data from unauthorized access, loss, misuse, alteration, and disclosure.

Retention
Unless otherwise required by law or agreement, Intempt retains:
- Website logs: 3 years
- Product audit logs: 3 years
- Customer Data: 3 years (subject to customer-controlled deletion tools in-product)
- Backups: 3 years
Retention may be shorter or longer where required to comply with law, resolve disputes, enforce agreements, or for legitimate security purposes.
Security Incident Notification
Where we are required to notify customers of a personal data breach under applicable law or contract, we will do so within 72 hours of confirmation, where feasible and legally required.
6. Cookies and Similar Technologies
We use cookies and similar technologies (including pixels and SDKs where applicable) for:
- Authentication and session management
- Security and fraud prevention
- Analytics and site performance
- Marketing and advertising (including retargeting), where enabled
We provide a cookie banner and preference center for EU/UK visitors (and others where applicable). You can also control cookies via browser settings.
Global Privacy Control (GPC)
At this time, Intempt does not respond to Global Privacy Control (GPC) signals. We may update this approach over time.
7. Your Privacy Rights and Choices
7.1 Your Choices
- Marketing emails from Intempt: You can opt out via the unsubscribe link in our emails. We may still send non-marketing messages (e.g., account/security notices).
- Cookie preferences: You may manage cookies via our cookie preference tools and your browser settings.
7.2 Requests (Access, Deletion, Correction, etc.)
Depending on where you live, you may have rights to access, correct, delete, restrict, object to processing, or receive a copy of your Personal Data.

We verify identity for requests using at least the email address associated with the request.
7.3 Customer Data Requests
For Customer Data processed on behalf of a customer:
- You should contact the customer directly, and/or
- the customer may use Intempt’s in-product tools to fulfill requests.
8. California Privacy Rights (CCPA/CPRA)
This section applies to California residents where Intempt acts as a “business” under California law.
8.1 Categories Collected / Disclosed
In the past 12 months, we may have collected categories such as identifiers (name/email), internet/network activity (cookie and website interactions), professional information, and commercial information (subscription administration). We may disclose these categories to service providers for business purposes.
8.2 “Sale” or “Share” (Targeted Advertising)
Under California law, some forms of targeted advertising and related disclosures (including use of third-party ad cookies/pixels and enhanced conversions) may be considered “selling” or “sharing” Personal Information.
Your right to opt out: You may have the right to opt out of “sale” or “sharing” of Personal Information.

We do not knowingly sell or share Personal Information of children under 16.
9. Other Important Privacy Information
9.1 Children
Our Services are not directed to children, and we do not knowingly collect Personal Data from children.
9.2 Third-Party Links and Integrations
The Services may link to or integrate with third-party services. Their privacy practices are governed by their own policies, and customers are responsible for what they connect and enable.
