8. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INTEMPT'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). INTEMPT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITES.

10. Governing Law. These Website Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles. The exclusive venue for any disputes shall be the state and federal courts located in Austin, Texas.
